COMPLIANCE
The main driver for the concrete restoration project is bringing all 19 buildings of the Cypress Bend Condo I community to compliance with safety regulations and milestone inspections as stipulated by Florida Statute 2023-203. For the buildings of our community we must have a milestone inspection done by December 31st, 2024. There are no longer 40/50 year inspections required in South Florida. Our buildings are due for a 10 year periodic inspections only.
Scope of work that needs to be done is determined by an engineering company conducting inspections in lieu of safety concerns as relates to our buildings as the only objective in focus. There are no specific requirements that need to be met are imposed by the City of Pompano or the State of Florida. It is up to inspections and assessment that work need to be done to assure compliance to safety of the construction.
Fines:
At present Cypress Bend Condo I community has been issued 2 violations : Building 2300 - $100 and Building 2320 - $100. So in total our community has $200 worth of fines (note: this is total and not per day). The City of Pompano permit department expressed no concerns with the current state of the Cypress Bend Condo I community, stating there will be no fines so long that the Department can see us progressing to reach the milestone compliance certification.
At the February 15th Board meeting :
1. A scare tactics has been used to promote and approve a project with highly exaggerated dollar amount and unclear benefit to the Community
2. The dollar amount requested ignores financial ability of the large portion of the Community. This brings unnecessary hardship on people and destroys the ownership value of the entire Membership.
As a result the Board signed the Community into a 15 million dollar liability over a 4-year term project.
A petition signed by 30+ percent of voting owners demanded to refrain from voting on the package and cooperate with the community on reaching the compliance certification objectives at reasonable costs.
The Board refused to show any cooperation.
In consequence to Board actions, Cypress Bend Condo I Community ACTION PLAN :
- Recall the Board - process starts March 20 , 2024. The votes are being collected now.
- Elect a new Board - upon completion of step 1, before May 31, 2024
- Review decision approved by the Board regarding the Assessment, target time frame June, 2024
- Establish a Committee to address requirements of the milestone Certification as an focused and affordable project, target time frame June-July, 2024
