It has been a year since the Association announced the assessment in February 2024. As you may recall, the majority of our ownership expressed strong opposition to this initiative. Over the past year, we have taken several actions to address these concerns, including submitting three petitions aimed at halting the high-spending project:
Petition Not to Vote for Assessment (February 2024): Presented to the Board prior to voting process; however, it was neither acknowledged nor mentioned during the assessment voting meeting.
Board Recall Petition (July 2024): Submitted with the intent to recall the Board due to its disregard for ownership concerns.
Board Recall Petition (October 2024): A follow-up petition reinforcing the call for the Board’s removal.
Additionally, we requested that the Board provide a detailed accounting of how the assessment funds are being allocated, including specific expenditures and their purposes. Despite these requests, we have received no transparency or financial breakdown—only repeated rejections from the Board.
This raises an important question: If there is nothing to hide, why the secrecy? And, after so many years, why is the Board so unwilling to step aside and allow fresh leadership?
In pursuit of accountability, we escalated the matter to the Florida State Regulator, DBPR. Following a thorough review, the DBPR Arbitration ruled that all objections raised by the Board regarding the validity of petition signatures were invalid. Consequently, the Board was ordered to step down (refer to the copy of the order). However, instead of complying with this decision, the Board has chosen to use Association funds—our money—to file a court appeal against the DBPR’s ruling.
Moreover, the Board continues to leverage its position, platform, and communications to promote narratives aimed at intimidating ownership, citing potential penalties, “suspicious activities,” “clarifications,” and “unbreakable contracts.” The reality is straightforward: the Board has been ordered by DBPR Arbitration to step down and is now seeking to circumvent this order at any cost.
As we approach the voting process, we encourage you to consider the following: Why is the Board fighting so hard to retain power? What vested interests could they have in maintaining control over an unpaid position, especially when it involves pushing forward a high-spending project that lacks justification and transparency?
